Probate. For many people, the thought of probate conjures up images or memories of a court process they’d rather forget or at least one to which they’d rather not subject their loved ones. Legally speaking, probate of a decedent’s estate is the method by which real and personal property is transferred from someone who owned it at their death to whomever is to be the new owner. In actuality, it can be a simple legal process, although sometimes a lengthy one, with the help of an experienced professional. Probate also includes guardianships and conservatorships as well as controversies involving estates, trusts and powers of attorney.
